By downloading, installing, or using Hearly ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Hearly is a personal sound amplification product (PSAP) that uses your iPhone's microphone to capture ambient sound, process it in real-time, and deliver amplified audio through your headphones. The App also provides hearing test functionality, sound profile customization, and audio recording features.
Hearly is not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition, including hearing loss. The App is designed as a personal sound amplification product for individuals with normal to mild hearing difficulty.
The built-in hearing test is for personalization purposes only and does not constitute a clinical audiological evaluation. If you suspect you have hearing loss or any other medical condition, consult a qualified healthcare professional or audiologist.
Important: Prolonged exposure to amplified sound may cause hearing damage. Always use the App at safe volume levels. You are solely responsible for monitoring your listening levels.
You must be at least 13 years of age to use the App. If you are under 18, you may only use the App with the involvement and consent of a parent or legal guardian. Parents and guardians are responsible for monitoring their children's use of the App and ensuring safe listening levels.
Hearly does not require account creation or sign-in. All data is stored locally on your device. Your use of the App is anonymous.
Hearly offers a free tier with limited functionality, including time-limited amplification sessions and basic sound profiles.
Premium features (unlimited amplification, custom profiles, recording, transcription) are available through an auto-renewable subscription purchased via the Apple App Store.
If offered, a free trial period automatically converts to a paid subscription unless cancelled before the trial ends. Any unused portion of a free trial is forfeited upon purchasing a subscription.
All purchases are processed by Apple. Refund requests must be directed to Apple through their standard refund process at reportaproblem.apple.com.

The App includes a recording feature. You are solely responsible for complying with all applicable local, state, national, and international laws regarding recording conversations. Many jurisdictions require consent from all parties before recording. Hearly is not responsible for any illegal recordings made using the App.
All content, design, code, and functionality of Hearly are the exclusive property of Hearly and its developers. These Terms do not grant you any intellectual property rights in the App beyond a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Our total liability for any claim arising from or related to the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.
You agree to indemnify and hold harmless Hearly and its developers from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business. Upon termination, your right to use the App ceases immediately.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hearly regarding your use of the App.
